Terms and Conditions Of Hire
1. Eligibility & Agreement
By signing this agreement, the Hirer confirms they:
Are aged 21 or over.
Hold a full, valid UK driving licence with no more than 6 penalty points.
Are authorised to drive the vehicle and will not allow any unauthorised person to drive it.
Accept these Terms and Conditions as a legally binding agreement governed by the laws of Scotland.
2. Insurance & Liability
The vehicle is insured by ProTouch Automotive Ltd. However, the Hirer is fully responsible for:
Any accidental or deliberate damage, theft, or loss during the hire period, up to the full insurance excess.
The entire cost of damage or replacement if insurance is invalidated due to misuse or breach of terms.
Damage to wheels, tyres, windows, mirrors, underbody, or interior.
Loss of use while the vehicle is undergoing repairs due to damage caused by the Hirer.
3. Prohibited Uses
The vehicle must not be used for:
Hire or reward, courier or taxi work, driving instruction, racing, or off-road use.
Towing, carrying hazardous goods, or transporting passengers or animals (unless previously agreed).
Driving under the influence of alcohol, drugs, or impairing prescription medication.
Smoking or vaping inside the vehicle – a £150 cleaning fee applies for any evidence.
Eating or drinking inside the vehicle.
Unauthorised modifications or tampering with the vehicle, its electronics, cameras, or tracking systems.
4. Surveillance & Monitoring
All rental vehicles are equipped with GPS trackers and dash cameras (front and rear) for safety, insurance, and theft protection.
By hiring the vehicle, the Hirer consents to this monitoring and understands that all footage remains the property of ProTouch Automotive Ltd.
Tampering with or disabling these systems is strictly prohibited.
5. Vehicle Condition & Handover
The vehicle is provided clean, fully roadworthy, and in good condition. A walk around Vehicle Condition Report will be carried out prior to hire and return of the vehicle.
The Hirer must:
Maintain fuel, oil, and water levels as needed.
Keep the vehicle secure at all times.
Return the vehicle with the same fuel level as at collection (or pay for refuelling).
Take reasonable care to prevent any damage or excessive wear.
6. Accidents & Damage
The Hirer must report any accident, damage, or incident immediately ProTouch Automotive Ltd and to Police Scotland (where applicable).
The Hirer must not:
Admit liability.
Attempt any repairs without written authorisation.
Leave the scene without collecting names, details, and evidence (where safe to do so).
A crime reference number is required in the event of theft.
7. Breakdowns
Breakdown cover is included; emergency contact details will be provided.
ProTouch Automotive Ltd is not liable for inconvenience, loss, or costs arising from breakdowns outside its control.
8. Vehicle Return
The vehicle must be returned on the agreed date and time, clean and in the same condition (excluding fair wear and tear).
Unauthorised extensions may incur a daily charge.
If returned excessively dirty, cleaning charges apply:
£30 standard cleaning fee.
Up to £150 for professional valeting (e.g. stains, spills, pet hair).
Lost keys or lockouts may incur full replacement and locksmith costs.
9. Fines & Penalties
The Hirer is liable for all driving offences during the rental, including:
Speeding, parking, bus lane, and congestion charges.
Low emission zone (LEZ) or ULEZ penalties.
A £25 admin fee per offence applies for processing charges received after the rental.
10. Mileage Limit
A mileage limit of 50 miles per day applies. Additional miles are charged at £1.00 per mile.
11. Courtesy Vehicle Terms
This vehicle is provided as a temporary courtesy vehicle while the Hirer’s own vehicle is undergoing repairs by ProTouch Automotive Ltd
ProTouch Automotive Ltd reserves the right to withdraw the vehicle at any time, especially in the event of delays caused by third parties (e.g. insurers).
12. Early Termination
ProTouch Automotive Ltd reserves the right to terminate this agreement and recover the vehicle without notice if:
The Hirer breaches any term of this agreement.
There is suspicion of misuse or illegal activity.
The vehicle is at risk of damage or theft.
13. Indemnity
The Hirer agrees to indemnify the Company against any:
Third-party claims, penalties, or fines arising from use of the vehicle.
Legal costs, damage, loss, or liability resulting from the Hirer’s use or breach of this agreement.
14. Governing Law
This agreement is governed by and construed in accordance with the laws of Scotland, and any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
15. Declaration by Hirer
By signing below, I confirm:
I have read, understood, and accept these Terms & Conditions.
I am liable for the vehicle during the rental period.
I consent to GPS tracking and dashcam recording during use.
